These Terms and Conditions of Use (“Terms”) govern your access to and use of www.mortimerlegal.com, including its pages, content, features, forms, and other online services (collectively, the “Website”).
The Website is owned and operated by:
Mortimer Legal, PLLC
200 Broadhollow Road, Suite 207
Melville, New York 11747
Telephone: 516-874-7616
Email: info@mortimerlegal.com
Please read these Terms carefully before using the Website. By accessing or using the Website, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you should not use the Website.
1. Definitions
For purposes of these Terms:
- “Firm,” “we,” “us,” or “our” means Mortimer Legal, PLLC.
- “Principal Attorney” means Deborah C. Mortimer.
- “You” or “your” means any person who accesses or uses the Website, whether acting individually or on behalf of a business, nonprofit organization, social enterprise, or other entity.
- “Client” means a person or entity with whom the Firm has established an attorney-client relationship through a written engagement agreement.
- “Website” means www.mortimerlegal.com and the content, pages, forms, and services made available through that website.
2. No Attorney-Client Relationship
Your access to or use of the Website does not create an attorney-client relationship between you and Mortimer Legal, PLLC or Deborah C. Mortimer.
Submitting a contact form, scheduling or participating in a consultation, sending an email, leaving a voicemail, or otherwise communicating with the Firm does not, by itself, create an attorney-client relationship or obligate the Firm to represent you.
An attorney-client relationship is established only after:
- the Firm has completed any necessary conflict-of-interest review;
- the Firm and the prospective client have entered into a written engagement agreement identifying the scope and terms of the representation; and
- any required retainer, advance fee, or other payment specified in the engagement agreement has been received or other payment arrangements have been accepted by the Firm.
The Firm reserves the right to decline any request for legal services for any lawful reason. You should not rely on the Firm to protect your rights or meet any deadline unless and until the Firm expressly agrees in writing to represent you concerning that matter.
3. No Legal Advice
The Website is provided for general informational and educational purposes only. Nothing on the Website constitutes legal advice, creates a legal opinion, or should be relied upon as a substitute for advice from a qualified attorney concerning your particular circumstances.
Legal rules and procedures vary by jurisdiction and may change over time. Website content may not reflect the most recent legal developments and may not apply to your circumstances or jurisdiction.
You should not act, or refrain from acting, based on information obtained from the Website without first consulting a qualified attorney. The Firm disclaims liability for actions taken or not taken in reliance on Website content, to the fullest extent permitted by law.
4. Geographic Scope and Limitations of Services
Mortimer Legal, PLLC serves clients located throughout the United States and internationally, subject to applicable licensing requirements, professional-conduct rules, jurisdictional limitations, and the nature of the particular matter.
The Principal Attorney is admitted to practice law in New York and New Jersey and may advise clients regarding matters involving United States federal law, including federal trademark and copyright matters, to the extent permitted by applicable law and professional rules.
The Firm does not represent that the Principal Attorney is admitted to practice law in every U.S. state, territory, foreign country, or other jurisdiction. Where a matter requires advice regarding the law of another jurisdiction, the Firm may decline the matter, limit the scope of its services, or recommend or work with appropriately licensed local or foreign counsel.
The Firm does not represent clients in litigation. The Firm’s dispute-resolution and enforcement services are limited to pre-litigation activities, including negotiation and settlement efforts. If a matter proceeds to, or reasonably requires, litigation, the Firm may refer the Client to qualified outside litigation counsel. Any engagement of outside litigation counsel will be subject to a separate agreement between the Client and that attorney or law firm, including separate terms regarding the scope of representation, fees, costs, and expenses. The Firm does not guarantee that any particular attorney or law firm will accept the matter and is not responsible for the services provided by independently retained outside counsel.
The availability of the Website in a particular jurisdiction does not constitute an offer to provide legal services in that jurisdiction and does not represent that the Firm is authorized to practice law there.
5. Legal Services
Information about the Firm’s general practice areas and services may be available through the “Services” or similar sections of the Website.
Descriptions of services are general in nature and do not constitute a commitment to perform any particular service. The scope of services provided to a Client will be governed exclusively by the Client’s written engagement agreement with the Firm.
The Firm may add, modify, suspend, or discontinue any service described on the Website at any time and without prior notice.
6. Fees and Government Charges
The Website may contain information about flat fees, estimated fees, starting fees, fee ranges, or other pricing for certain legal services. Unless expressly stated otherwise in a written engagement agreement, Website pricing is provided for general informational purposes only and does not constitute a binding quote or offer.
The fees applicable to a particular matter may vary depending on its scope, complexity, urgency, number of marks or works involved, number of classes, filing basis, procedural history, geographic coverage, and other circumstances. The Firm may modify the fees displayed on the Website at any time. Any change will not modify the fees stated in an existing, fully executed engagement agreement unless permitted by that agreement and applicable law.
Government filing fees, foreign-associate fees, search-provider charges, translation expenses, courier costs, and other third-party expenses are separate from the Firm’s legal fees unless expressly stated otherwise in writing.
USPTO and other government fees are established by the applicable government agency and may change without notice. Trademark application fees are generally assessed on a per-class basis, and additional government fees may apply depending on the filing basis, application content, identification of goods or services, and later filings.
Additional legal fees and government charges may apply to services including:
- responses to office actions;
- amendments or supplemental submissions;
- statements of use and amendments to allege use;
- extension requests;
- petitions;
- oppositions and cancellations;
- declarations of use or excusable nonuse;
- renewals and maintenance filings;
- assignments and ownership changes;
- monitoring and enforcement matters;
- licensing matters;
- foreign or international filings; and
- services outside the scope of the original engagement.
The Client’s written engagement agreement controls if there is any inconsistency between the agreement and information displayed on the Website.
7. No Guarantee of Outcome
Trademark, copyright, and other legal matters involve decisions by courts, government agencies, examining attorneys, registries, and third parties that are outside the Firm’s control.
The Firm does not guarantee:
- that a trademark or copyright application will be accepted, approved, or registered;
- that a search will identify every potentially relevant right, use, registration, or application;
- that an application will proceed without objection, refusal, opposition, cancellation, or other challenge;
- that a particular legal strategy will succeed;
- that enforcement efforts will achieve a particular result; or
- that any matter will be completed by a particular date.
Any discussion of possible results is an expression of professional judgment based on the information available at that time and is not a promise or guarantee.
Prior results do not guarantee a similar outcome.
8. No Confidential Communications Before Engagement
Unless you are already a Client concerning the relevant matter, you should not submit confidential, proprietary, sensitive, or time-critical information through the Website, by email, through a contact form, or during an initial inquiry.
Information submitted before an attorney-client relationship has been established may not be protected by the attorney-client privilege or treated as confidential. Submission of information does not prevent the Firm from representing another person or entity whose interests may be adverse to yours, subject to the Firm’s professional obligations and applicable law.
Although the Firm takes reasonable measures to protect its communications and systems, internet and email communications cannot be guaranteed to be secure, error-free, or confidential. You accept the risks associated with transmitting information electronically.
Current Clients should use the communication methods and security procedures provided or approved by the Firm.
9. Attorney Advertising
This Website may constitute attorney advertising under the laws and professional-conduct rules of certain jurisdictions.
The Website is not intended to create unjustified expectations regarding the results the Firm can achieve. Testimonials, endorsements, representative matters, case descriptions, or past results—if displayed—do not guarantee or predict the outcome of any other matter. Every legal matter depends on its own facts, circumstances, governing law, and procedural posture.
Prior results do not guarantee a similar outcome.
New York’s professional-conduct rules prohibit false, deceptive, or misleading lawyer advertising and regulate statements concerning legal fees and prior results. (nycourts.gov

10. Intellectual Property and Limited License
Unless otherwise indicated, the Website and its original content—including text, graphics, logos, design elements, downloads, compilations, and other materials—are owned by or licensed to Mortimer Legal, PLLC and are protected by copyright, trademark, and other intellectual-property laws.
Subject to these Terms, the Firm grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Website for lawful personal or internal business purposes.
You may print or save a reasonable number of copies of Website materials for your own noncommercial, informational use, provided that you do not remove or alter any copyright, trademark, attribution, or proprietary notice.
Without the Firm’s prior written consent, you may not:
- reproduce, republish, distribute, sell, license, or commercially exploit Website content;
- modify, translate, adapt, or create derivative works from Website content;
- use Website content as legal advice, a legal form, or a substitute for professional services;
- frame, mirror, scrape, or systematically extract Website content;
- use automated tools to access, copy, monitor, or interfere with the Website;
- use the Firm’s name, trademarks, logos, or branding in a manner likely to cause confusion;
- falsely imply sponsorship, endorsement, affiliation, or approval by the Firm; or
- use Website content for unlawful or infringing purposes.
Nothing in these Terms transfers ownership of any intellectual-property right to you.
11. Acceptable Use
You agree not to use the Website:
- in violation of any applicable law, regulation, court order, or third-party right;
- for any fraudulent, deceptive, defamatory, threatening, abusive, or harmful purpose;
- to transmit malware, malicious code, or other harmful technology;
- to interfere with the Website’s operation, security, availability, or functionality;
- to gain unauthorized access to any account, system, network, or data;
- to impersonate another person or misrepresent your identity or affiliation;
- to collect information about other users without authorization;
- to submit false, misleading, or incomplete information to the Firm; or
- to engage in conduct that imposes an unreasonable burden on the Website or its infrastructure.
The Firm may restrict or terminate access to the Website if it reasonably believes a user has violated these Terms or applicable law.
12. Third-Party Websites and Services
The Website may contain links to third-party websites, government agencies, service providers, social-media platforms, or other external resources. These links are provided for convenience and informational purposes only.
The Firm does not control and is not responsible for third-party websites, services, availability, security, privacy practices, accuracy, or content. A link does not imply that the Firm sponsors, endorses, or is affiliated with the third party.
Your use of third-party websites and services is governed by the terms and privacy policies of those third parties.
13. Privacy
The Firm’s collection and use of personal information through the Website are governed by the Firm’s Privacy Policy, if separately posted. By using the Website, you acknowledge that information submitted through the Website may be processed as described in the applicable
Privacy Policy.
These Terms do not replace or limit any rights or obligations stated in the Privacy Policy.
14. Website Availability and Security
The Firm may modify, suspend, restrict, or discontinue any portion of the Website at any time without notice.
The Firm does not guarantee that the Website will be uninterrupted, secure, error-free, or free of viruses or other harmful components. You are responsible for maintaining appropriate security measures, backups, and protective software when accessing the Website or downloading materials.
15. Disclaimer of Warranties
To the fullest extent permitted by law, the Website and all Website content are provided on an “as is” and “as available”basis.
The Firm disclaims all warranties and representations, express or implied, relating to the Website and its content, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy, availability, security, and noninfringement.
The Firm does not warrant that Website content is complete, current, accurate, or applicable to your particular circumstances.
Nothing in this section limits any obligation that cannot lawfully be limited or waived.
16. Limitation of Liability
To the fullest extent permitted by law, Mortimer Legal, PLLC and its members, attorneys, employees, contractors, agents, and representatives will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to:
- your access to, use of, or inability to use the Website;
- your reliance on Website content;
- unauthorized access to or alteration of communications submitted through the Website;
- malicious software, service interruptions, or technical failures; or
- third-party websites, content, products, or services.
This limitation applies regardless of the legal theory asserted and even if the Firm has been advised of the possibility of such damages.
This section applies only to claims arising from the Website and does not limit any duty or liability arising from an attorney-client relationship or any liability that cannot lawfully be excluded or limited.
17. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Mortimer Legal, PLLC and its members, attorneys, employees, contractors, agents, and representatives from claims, damages, liabilities, judgments, costs, and reasonable attorneys’ fees arising from:
- your unlawful or unauthorized use of the Website;
- your material violation of these Terms;
- content or information you submit through the Website;
- your infringement or violation of another person’s rights; or
- your intentional interference with the Website’s security or operation.
This provision does not require you to indemnify any person for that person’s own professional negligence, willful misconduct, or other liability that cannot lawfully be shifted or waived.
18. Changes to These Terms
The Firm may revise these Terms periodically. Revised Terms become effective when posted on the Website unless a later effective date is stated.
Your continued use of the Website after revised Terms become effective constitutes acceptance of those revisions. You should review this page periodically for updates.
19. Assignment
You may not assign or transfer your rights or obligations under these Terms without the Firm’s prior written consent.
The Firm may assign its rights and obligations relating to the operation of the Website in connection with a merger, reorganization, transfer of assets, change in business structure, or engagement of a successor Website operator, subject to applicable law.
20. Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or, if necessary, severed. The remaining provisions will remain in full force and effect.
21. No Waiver
The Firm’s failure to enforce any provision of these Terms will not constitute a waiver of that provision or of the right to enforce it later.
22. Entire Agreement
These Terms, together with any applicable Privacy Policy and other notices expressly incorporated by reference, constitute the entire agreement between you and the Firm concerning your use of the Website.
These Terms do not replace or modify a Client’s written engagement agreement. If there is a conflict concerning legal services provided to a Client, the written engagement agreement will control.
23. Governing Law and Forum
These Terms and any dispute arising from or relating to the Website will be governed by the laws of the State of New York, without regard to its conflict-of-laws principles.
To the fullest extent permitted by law, any legal proceeding arising exclusively from your use of the Website or these Terms must be brought in a state court located in Suffolk County, New York, or in a federal court having jurisdiction over Suffolk County, New York. You consent to the personal jurisdiction and venue of those courts.
This section does not govern venue or dispute-resolution requirements contained in a separate written engagement agreement between the Firm and a Client.
